JEFFREY GOLDBERG: Our firm has handled probably more birth injuries than almost any other firm in the state of Illinois, Wisconsin and several other Midwest states.
I think there are only very few of us that concentrate in the area and do enough of it to really understand the very complicated complex medical issues, both in terms of whether the doctors or nurses were doing what was right, but also more importantly today in trying to prove that what the doctors did was the actual cause of the cerebral palsy or other injury that is devastating the life of the young child.
Birth injury litigation is probably one of the most emotionally charged areas of litigation there is. It's one thing to know that a patient themselves is suffering an injury, but to know that their child will never grow up to be normal, never walk independently, never live independently and never go on to do those things we want for all of our children is horribly devastating on the immediate family but also on the extended family.
I try to visit the home of as many clients as I possibly can. I want to make sure that I can understand what the family is going through and how they care for their child. It's only through that understanding that we can adequately present to the jury the true situation.
I do think that by the litigation we conduct we help hospitals realize they have to police themselves, they have to provide the best medical care, and they have to rid themselves of practitioners that aren't practicing at a reasonable standard, otherwise they will be subjected to significant verdicts and settlements.
