Chicago, Illinois and Milwaukee, Wisconsin Law Firm Helping Victims of Brachial Plexus Injury

A network of nerves originating in the spinal cord controls movement from the shoulder through the hand . When this network suffers injury during childbirth, infants typically face a number of medical conditions that result in a lifetime of disability. When these conditions result from medical negligence, the experienced Illinois and Wisconsin attorneys at the Jeffrey M. Goldberg Law Offices provide dedicated support to victims of brachial plexus palsy to help ensure they pursue the compensation needed to pay for a potential lifetime of special needs.

What Wisconsin and Illinois Families Need to Know About Erbs Palsy and Similar Conditions

Erb's palsy is a condition affecting the network of nerves that runs from the neck, across the shoulder, to the arm and the hand. The most serious cases of Erbs palsy render the whole arm, elbow and hand essentially useless. Klumpke's palsy is similar to Erb's palsy, but it generally affects only the hand.

Both conditions may result from birth trauma often closely connected to failure of physicians to perform an appropriate mode of delivery.

Our attorneys at Jeffrey M. Goldberg Law Offices represent families throughout the United States whose children were born with shoulder dystocia, Erb's palsy, Klumpke's palsy, Horner's syndrome and other types of brachial plexus injuries. Warning Signs, Risk Factors

A number of factors can raise the risk of brachial plexus nerve damage occurring due to birth trauma. These include vaginal delivery of a baby that is estimated to be 10 lbs. or larger at birth, an awkwardly positioned baby (transverse or breech), the development of gestational diabetes in the mother, excessive weight gain by the mother, a pregnancy lasting beyond 40 weeks, and an extended or protracted second stage of labor.

Case Results

An expectant mother presented at her hospital in Chicago for the delivery of her first child. Her physician was not present and the hospital's "house doctor", who had not been formally trained in obstetrics, was managing the labor with attending nurses. By the time the personal physician arrived the fetus had suffered a significant lack of oxygen and was delivered in a very depressed state. The baby developed cerebral palsy. On the eve of trial, the hospital and other defendants offered a global settlement with a present cash value in excess of $13,000,000.00 including some portions in cash and future payments that will support the child for life.
