An expectant mother presented for an induction of labor. The nurse midwife elected to start Pitocin. Immediately thereafter, the uterus developed a pattern of hyperstimulation, too frequent contractions, and the fetus started showing fetal heart rate decelerations. Despite these abnormalities, the nurse midwife continued increasing Pitocin in excess of recommended protocols. At birth, the child was born severely depressed and had suffered a brain injury from lack of oxygen. A jury entered a verdict in favor of plaintiffs in an amount of approximately $13,700,000.

A Milwaukee County jury returned a verdict in favor of the plaintiffs in a birth injury case, which exceeded $23,000,000 against the doctor and will be payable by both the doctor and Injured Patients and Families' Compensation Fund. There had been no offer prior to trial.
