Proposed Illinois Birth Injury Fund Would Help Hospitals, Deprive Victims Of Legal Rights

In Maryland, lawmakers are considering creating a no-fault birth injury fund for the parents of children who are injured during labor and delivery. This would allow the parents to receive compensation from an established state fund instead of by filing claims against hospitals and physicians in court.

CAN I PURSUE DAMAGES FOR PAIN AND SUFFERING UNDER WISCONSIN MEDICAL MALPRACTICE LAW?

Because no absolute dollar amount can be placed on pain and suffering, these damages fall under the classification of non-economic damages, according to Wisconsin law. If the negligent acts of a medical provider leave you or a loved one with life-changing injuries, it takes a toll on the entire family. In addition to allowing medical malpractice victims to pursue fair compensation for pain and suffering, Wisconsin law permits them to pursue other non-economic damages, subject to specific limitations.

In many cases, incorrect diagnoses result in incorrect treatments or no treatment at all. Diagnoses are at the core of all medical treatment, and it turns out diagnostic failure may be at the core of a majority of medical malpractice cases.
