Firm Sues to Have Medical Malpractice Caps Declared Unconstitutional on Behalf of Client

Jeffrey M. Goldberg Law Offices successfully prosecuted a case challenging the Medical Malpractice Caps on behalf of Abigaile Lebron, a 4½-year-old child injured at birth due to physician and hospital negligence. She now has Cerebral Palsy as a result. The law firm filed a declaratory action seeking to have a new law that limited the amount that could be recovered for the victim declared unconstitutional, so that it could not be applied to Abigaile or any other person within the State of Illinois.

On Thursday, February 4, 2010, the Illinois Supreme Court declared the legislation was unconstitutional and would never be applied to affect the rights of injured citizens. This landmark decision will serve to protect the rights of people injured through medical negligence throughout Illinois.

Her physician was not present and the hospital's "house doctor", who had not been formally trained in obstetrics, was managing the labor with attending nurses.
